Revenue amounted to $217m (€187.4m) and bookings climbed 12% to £233.9m. Zynga saw 7% year-on-year revenue growth within its mobile business during Q2, with this part of the group now responsible for 89% of total revenue. The revelation comes after Farmville creator Zynga bolstered its mobile arm offering in Q2 when it acquired mobile games developer Gram Games for $250m. Gram Games titles have collectively been downloaded more than 170 million times worldwide. In a statement, Zynga said the Gram Games deal, as well as its acquisition of Casual Cards last year, will have more of an impact on business during the third quarter. “We anticipate that our year-over-year growth will benefit from full quarter contributions from our Casual Cards and Gram Games acquisitions as well as strength across our forever franchises,” Zynga said in a statement. “We continue to expect our sequential and year-over-year progression to be affected by declines in web and older mobile games. Despite revenue growth, Zynga did report an 11% year-on-year drop in adjusted EBITDA, as well as a loss of $900,000, compared to profit of $5.1m in Q2 of last year. However, Zynga was seemingly happy with the result, saying that the adjusted EBITDA figure was above guidance by $7.7m. Similarly, Zynga said net loss was some $14.1m ahead of initial forecasts. He tells iGamingBusiness.com why he believes this build-as-you-go approach will help generate sufficient support to bring sports betting legislation into law.In February this year, newly installed Illinois Governor J.B. Pritzker factored in $200m in future tax revenue from wagering activities in his 2020 budget proposal. This included $17m of tax revenue for fiscal year 2020, such is his confidence that regulations will be passed in the current legislative session.This effectively sounded the starting pistol on a race to regulate sports betting in the state, with Representative Michael Zalewski currently ahead of the pack with House Bill 3308.When originally filed, HB3308 simply contained a title: “This act may be cited as the Sports Wagering Act.” The bill has been designed to offer Illinois lawmakers a blank slate through which consensus can be built on the best possible model for the state.“Gambling bills in Illinois have traditionally been difficult to pass, as we have struggled to find the right recipe to pass legislation,” Zalewski explains. “This time, rather than waiting to the end of the session to put together one big bill, we’ve put out one that allowed for lots of different methods to be discussed.”“I think it has actually worked out very well,” he says, with four amendments proposed when the bill was assigned to the House Rules Committee, and a fifth added ahead of a sports betting hearing held last week.Zalewski suggests that the ultimate goal is to hit Pritzker’s financial targets. Pritzker has already suggested a model whereby 20 licences will be issued, at a cost of $10m each, with licensees then taxed at 20% of sports betting revenue.Zalewski says that under this structure, the goal of raising $200m is “very reasonable”, and predicts that the state could then generate between $40m and $60m each year, depending on how fast the market matures. Raising the money may be the goal, but how it is raised remains up for debate.Multiple models Three of the models put forward retain the $10m licence fee. Zalewski himself has proposed what is being described as the “New Jersey model”. This would see land-based and riverboat casinos permitted to offer online and land-based wagering, and allowed to operate skins as sub-licensees. Land-based revenue would be taxed at 15%, with online and mobile wagering taxed at 20% of revenue.The second amendment, put forward by Representative Katie Stewart, is described as the “Mississippi model”. This would see racetracks, casinos and off-track facilities allowed to offer wagering, though only 10 online licences would be available to land-based casinos.Representative André Thapedi’s proposal, meanwhile, has been dubbed the “professional sports league amendment”. It cuts the tax rate to 12.5%, but mandates an additional levy of 0.25% of handle be paid to the Illinois Gaming Board. This would then be distributed to the US professional sports leagues and governing bodies.The final proposal, Elizabeth Hernandez’s “lottery oversight amendment”, would see all sports betting conducted via the Department of the Lottery. It would limit sports betting in Illinois to land-based channels, with 50% of gross sports betting receipts to go to the state.The quartet was joined by a fifth ahead of last week’s hearing, added by Representative Bob Rita. This simply sets out a so-called bad actor clause, which states that any business that has accepted wagers in the state before legislation is passed be blocked from applying for a licence.It was made clear in the hearing that this is designed to block FanDuel and DraftKings from the market. The pair continued to offer daily fantasy contests in the state after the games were ruled to violate state law in 2015, and continue to dispute the ruling.While he put forward the so-called New Jersey model, Zalewski says that he did so as the legislation is “the most similar to what people would broadly expect a bill to look like”.Courting brick-and-mortar support “It gives the brick-and-mortar casinos and racetracks priority, whose support will be needed,” he explains. “I’m not wedded to it by any stretch; the other amendments we filed are also viable regulatory models, though I think the New Jersey model is a good starting point.”Ultimately, he says he will commit to supporting whichever regulatory model is chosen following the hearings and discussions with lawmakers.Yet this could mean he may find himself committing to backing the bad actor clause, which could potentially lock FanDuel and DraftKings, the leading lights of New Jersey’s regulated market, out of Illinois.“I think that amendment was put forward by a brick-and-mortar casino that was very interested in having sports wagering, that are very interested in having a corner of the market,” Zalewski says of Rita’s amendment. “They are very concerned that DFS will have an improper monopoly [due to the likes of FanDuel and DraftKings’ activity in the state], so asked for the amendment to be filed.“We will work with the casinos and the fantasy sports operators to try to reach an agreed disposition.”Despite the amendment shifting focus away from the core business of sports betting regulation during the hearing, he insists that bringing up such issues are important – even if he does suggest that it’s only a minor element of the debate.“I think it’s always healthy to have a good discourse and to allow people to negotiate these things in the open air, so I don’t mind healthy disagreement,” he says. “I think the DFS operators are a small part of this conversation, but I’m happy to have this sort of dialogue.”He says that such issues arise because, to an extent, the state’s brick-and-mortar casinos believe the sports betting conversation should centre around them.“They’ve invested a lot of capital and employ a lot of people, so they do play an important role, but I think it’s important to put the best policy forward for the state, so that’s why we’re keeping our options open,” Zalewski says.But keeping the options open means there is still a lot more work needing to be done. Zalewski says more hearings will take place in the coming weeks, to flesh out the proposals further, after which a new round of refined amendments will be introduced.“When we do that we’ll hopefully whittle down our options and come forth with an agreed bill,” he says.The clock is ticking, with the 2019 regular session ending on May 31. Betting revenue was up 5.5%, but all other areas saw declines in the first half.However, Stars was boosted by revenue growth from its UK operations, which comprises the Sky Betting & Gaming business. Revenue totalled $432.0m driven by $220.9m in betting revenue and $182.9m in gaming revenue.Stars also saw its Australian business, comprising the CrownBet and former William Hill Australia assets, report a 74.4% year-on-year increase in revenue to $126.2m, again driven by betting revenue, which was up 71.7% to $124.3m.In terms of spending, total adjusting items for the period stood at $432.1m, up from $343.3m last year. Depreciation and amortisation costs rocketed from $83.8m to $218.4m, while other costs climbed from $26.7m to $48.5m.However, such was the impact of Sky Betting & Gaming on Stars and its revenue in the first half that the operator was able to turn a net loss of $80.5m in the first half of last year to net earnings of $32.3m. Gross profit excluding depreciation and amortisation was also up 37.6% to $881.5m.Adjusted net earnings were down 9.9% year-on-year to $243.1m, but adjusted earnings before interest, tax, depreciation and amortisation (EBITDA) increased 25.9% to $432.1m.Stars was boosted by a positive performance in the second quarter, during which revenue hiked by 54.9% year-on-year to $637.6m. Again, this was mainly a result of the addition of Sky Betting & Gaming to the group, with online sports betting responsible for 36% of all revenue, compared to 20% last year.Stars said 79% of consolidated revenues were derived from locally regulated or taxed markets in the three months to June 30, compared to 61% in the same period last year.Aside from revenue, net earnings amounted to $4.6m in Q2, compared to a net loss of $154.8m last year, while gross profit increased 41.4% to $463.7m.“The second quarter underpinned the success of last year’s acquisitions, particularly with the record performance of Sky Betting & Gaming and our increasing product and geographic diversification, as we continue to transform and position the business to execute on our strategy for strong, sustainable future growth,” Stars’ chief executive, Rafi Ashkenazi, said.“2019 has been and remains a year of integration, execution and debt reduction. We are committed to those key strategic priorities for the rest of the year while we also build our foundation and momentum to become a market leader in the US.“We are confident that the actions we have taken over the last year, and are pursuing now, including to reassess our fixed cost base, put us in a strong position to deliver our mid-term growth targets from the end of 2019.”However, despite posting growth in the first half, Stars has moved to lower its full-year guidance. With this, the Foundation said it may also see a rise in problem gambling.Online gambling is more risky the other types of betting, the Foundation claimed, as it is easier to bet and lose money quickly. It highlighted factors such as players not keeping track of losses and the fact that online games are available all hours of the day.“Many scenarios can lead people to gamble online,” the Foundation’s principal clinical advisor Tony Clarkson said. “During this stressful period, some people may seek escape in a new activity or take up gambling again after a break.“Those accustomed to visiting a venue to gamble may try online gambling to manage their urges. Others might choose to participate in different forms of gambling available through various apps and websites.”The Foundation noted the impact of ‘personalised’ promotional offers via email, SMS, social media, pop-up ads or a combination of all of these. It said that such promotions make people think about betting more than normal, while also make it seem like everyone will win, even though some lose more than they win.“Online gambling may not feel satisfactory, and the risk is that people may end up gambling more – and losing more – to satisfy an urge,” Clarkson said. “The bottom line is that gambling doesn’t always relieve stress, but it can generate additional stress due to financial losses, and cause a person’s wellbeing to suffer.”In addition, the Foundation picked out other risks recently highlighted by the Australian Media and Communications Authority, including illegal gambling websites.The Foundation said that while these sites may appear legitimate, they operate outside Australian laws and do not comply with national customer protection regulations. In theory this largely applies to their land-based activities.  French monopolies under the social responsibility spotlight “However, excessive restrictions – or even a total ban on gaming advertising – would be counterproductive, as they would favour the development of illegal online gaming activities, leaving players and minors less protected,” it continued.  France’s new gambling regulator L’Autorité nationale des jeux (ANJ) pledged to pay particular attention to industry advertising and player protection in the coming year. But the companies targeted as it ramps up these efforts may be surprising, writes Jake Pollard. Essentially ANJ is saying that FDJ and PMU are very close to glamorising gambling and giving it an overly positive image. Looking back at some of the recent decisions published by the ANJ’s monitoring committee (collège), things become clearer.  Meanwhile PMU’s strategy to increase “the attractiveness of its offer and modernise its image can unintentionally lead to the targeting of young adults even though this category of the population presents a high risk of developing problem gambling” behaviours, ANJ said.  Topics: Legal & compliance Marketing & affiliates Compliance Regulation Marketing With regard to its activities, FDJ added: “Corporate and social responsibility has always been central to FDJ’s business model; the group’s aim is to market its products, but its priority is responsible gaming.  “In addition, in connection with this case law, ANJ will be vigilant to ensure that any advertising or promotional campaign by these operators does not hide behind arguments of general interest to give a positive image of gambling or to justify it.” Regulated operators also point out that marketing enables them to channel the vast majority of players to legal betting and gaming sites, even if context is also important in this instance.  If the wording of the comments towards both historic operators was somewhat surprising, it should also be viewed within the context of the commercial and competitive pressures FDJ and PMU are under.  The pandemic has of course had a major impact on both companies’ retail activities. FDJ’s activities suffered in 2020, while for PMU the closures of many hippodromes across France last year was keenly felt. But overall both companies’ offline activities also illustrate how they need to reform and rejuvenate their clientele.  The proactive monitoring of operators’ marketing and promotional activities shouldn’t come as a surprise. ANJ’s new president Isabelle Falque-Pierrotin spelled out her intention to put players at the heart of her work in an interview with iGB last year.  Compliance But when it comes to online verticals and specifically sports betting, FDJ’s Parions Sport and PMU.fr lag some distance behind the leading trio of Winamax, Betclic and Unibet. But so far ANJ is doing what it said it would. “To this end, the group has put in place specific measures, such as the commitment to devote 10% of its TV advertising budget to responsible gaming, a commitment not made by any other French operator.” The bluntness of ANJ’s press release was striking, mainly because it is so rare to see such language directed at national operators. By way of comparison, many British operators are adamant that the National Lottery should be more closely monitored when it comes to marketing and player communications. CSR central to business model France is steering a different course on the matter. There is no talk of forbidding operators from advertising on radio or TV; even if there are regular complaints, from both inside and outside the industry, bemoaning the volume of adverts for online bookmakers during half-time breaks.  “All of FDJ’s marketing materials are developed with this ultimate goal in mind. They also help channel player demand into controlled networks.” Noting the scope and ambition of both groups’ marketing strategies for 2021, ANJ warned that FDJ’s marketing should not “encourage a natural disposition towards gambling by making it appear commonplace or giving it a positive image linked to general interest activities or through the potential for major financial rewards.”  The current situation in Great Britain is a case in point. In England alone eight Premier League clubs have gambling operators as shirt sponsors. And with marketing being the most high-profile of the industry’s activities, it was always bound to be closely scrutinised.  A quick look at this slick FDJ promotional video gives an idea of what ANJ is referring to. Furthermore, the regulator’s industry data for the third quarter of 2020 showed that 56% of operators’ marketing budgets were spent on acquisition and retention of players. This indicates why its statement focused on personalisation and customer loyalty in its statement.  It made similar points about FDJ’s targeting of younger demographics and in relation to both groups’ personalisation and customer loyalty strategies. It said this could increase the intensity and frequency of those consumers’ betting and gaming habits. When it comes to advertising however, it also showed that legal advertising was not always needed to develop a substantial vertical. All point to the built-in commercial and regulatory advantages those groups have benefited from since 2010.  “Betting and gaming advertising is useful in that it channels player demand to controlled environments, promoting games that encourage moderate and responsible use. In this regard, ANJ has a key role to play, particularly with respect to online gaming activities, where advertising by operators is especially prevalent.” The average age of a PMU retail client is 45 years old, compared with 35 for an online horse racing enthusiast and around 30 years old for an online sports betting and poker player. FDJ’s core demographics, considering retail sales remain by far its largest channel, are likely to be similar.  “Beyond that, PMU must be a reference when it comes to responsible gambling and executes its strategy with that in mind.”  Many of these, such as PMU’s co-mingling of online and retail player pools for horse racing, had to be fought and eventually defeated via long and costly legal battles.  “Serious concerns”  But ANJ’s remit has also expanded considerably when compared to its online-focused predecessor L’Autorité de régulation des jeux en ligne (ARJEL). It oversees close to 80% of France’s gambling sector, including all FDJ and PMU retail outlets, whereas ARJEL only covered around 11% of the market. Its statements should also be seen in that context.  In late January, France’s igaming regulator the Autorité Nationale des Jeux(ANJ) published a statement in laying out its roadmap for monitoring operators’ promotional strategies for 2021. Few could have expected to read its blunt words about the marketing practices of national lottery monopoly La Française des Jeux (FDJ) and its horse racing equivalent Pari-Mutuel Urbain (PMU).  FDJ meanwhile told IGB that ANJ had “reminded all operators, and not only FDJ and PMU, of the need to strike the right balance in their marketing of betting and gaming activities.” In that respect Italy and Spain have gone further.
